OUTLINE<\/b><\/p>\n

  1. The \u2018Hire Company\u2019 is Tome Balloons and Decorations Inc.<\/span><\/li>\n
  2. The \u2018Client\u2019 refers to any individual, firm, or corporation hiring equipment or appoints services from the \u2018Hire Company\u2019.<\/span><\/li>\n
  3. The \u2018Equipment\u2019 refers to all furniture, decor, backdrops, tables, and associated packaging and storage containers supplied to the \u2018Client\u2019.<\/span><\/li>\n
  4. The \u2018Event Date\u2019 refers to the day of the event supplied by the \u2018Client\u2019 to the \u2018Hire Company\u2019.<\/span><\/li>\n<\/ol>\n

     <\/p>\n

    DEPOSIT & PAYMENTS<\/b><\/p>\n

     <\/p>\n

      \n
    • A 50% non-refundable deposit of your invoice is required within 24 hours of receiving your invoice to save your date.\u00a0<\/span><\/li>\n
    • Remaining balance is required 5 days prior to the Client\u2019s Event Date.<\/span><\/li>\n
    • Please be advised deposits are non-refundable, non-transferable, and cannot be exchanged for a credit note. Set-Up time cannot be confirmed unless full payment has been received\u00a0 5 days prior to the event.<\/span><\/li>\n
    • Dates will not be held without a deposit.\u00a0<\/span><\/li>\n
    • The Client agrees to pay any expenses incurred or loss suffered by the hire company as a result of breach by the Client of its obligations pursuant to these terms (including legal and debt recovery costs).<\/span><\/li>\n<\/ul>\n

       <\/p>\n

      HIRE CHARGES & DELIVERY<\/b><\/p>\n

       <\/p>\n

        \n
      • Unless otherwise specified, any delivery and pick up quotation assumes:<\/span>\n
          \n
        • Delivery, and pick up of Hire Equipment is provided during ordinary hours of 8:00 am to 8:00 pm; (b) any delivery and collection outside ordinary delivery hours will incur an extra surcharge;<\/span><\/li>\n
        • It is the responsibility of the Client to ensure measurements of Hire Equipment supplied by the Hire Company are appropriate for the event space including ceiling heights, door, and stair access. If at the time of delivery Hire Equipment does not fit, the Hire Company has the right to refuse delivery with no refund of the hire cost. If additional delivery is required the Client is subject to redelivery charges;<\/span><\/li>\n
        • Any permits needed are the responsibility of the Client.<\/span><\/li>\n
        • Public holiday surcharge applies to all bookings on public holidays; (f) delivery being made to street level.<\/span><\/li>\n
        • If delivery is required to a higher ground level, the Hire Company must be notified before the deposit is paid as an extra surcharge applies. If upon delivery there are stairs that the Hire Company was not previously notified of, the Client must pay an additional upstairs fee to the Hire Company before delivery commences.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

          • Grounds or floors being level and clear;<\/span><\/li>\n
          • All Equipment must be available for pick-up at the agreed date and time. Additional fees will incur if Equipment is not available for pick up at the agreed date and time.<\/span><\/li>\n<\/ul>\n

             <\/p>\n

            SPECIFIC PRODUCT HIRE CONDITIONS<\/b><\/p>\n

             <\/p>\n

              \n
            • Any form of decoration that was not supplied with the Hire Equipment needs to be removed ready for pickup for the Hire Company.<\/span><\/li>\n
            • Stands should be wiped down. All dessert residue must be removed from the cake stands. Do not wash cake stands under the sink as this will damage the cake stands entirely. For D.I.Y hire if the cake stands require cleaning after being returned, the client will incur a cleaning fee at a per hour rate of $40.<\/span><\/li>\n<\/ul>\n

               <\/p>\n

              DAMAGE TO ITEMS<\/b><\/p>\n

               <\/p>\n

                \n
              • All Hire Equipment is quality checked, counted, and cleaned prior to collection. The Client must notify the Hire Company of any missing items, damage, or dissatisfaction within 8 hours of D.I.Y hire collection or delivery. Otherwise, any damage or uncleanliness of equipment shall be deemed the Client\u2019s accountability.<\/span><\/li>\n
              • Upon delivery of the Hire Equipment and until the collection of the Hire Equipment by the Hire Company the Client has full responsibility for the Hire Equipment. The Client shall protect the equipment from the weather elements. Hire Equipment is not suitable for exposed outdoor use. It is the Client\u2019s responsibility to notify the Hire Company if Hire Equipment will be outdoors. Outdoor use is permitted under the condition that it is undercover such as marquees, pergolas, carport, and terraces.<\/span><\/li>\n
              • All deliveries of Hire Equipment require level and steady ground for safety and insurance purposes.<\/span><\/li>\n
              • It is the responsibility of the Client to ensure that the Hire Equipment is stored safely. The Client agrees to pay the full replacement cost of any equipment badly damaged, lost, or stolen during their hire period, including any lost packaging, storage crates, and bags.<\/span><\/li>\n
              • The Client agrees to pay any repairing costs to damaged Hire Equipment. Any damage to Hire Equipment will be decided by the Hire Company if it can be repaired or requires replacement. Burns, holes, tears, water damage, or other similar damage to Hire Equipment shall be replaced at full cost to the Client. Should the D.I.Y Hire Equipment not be returned by the agreed date following the Event Date the Client agrees to pay for continued hire fees, at a rate subject to the items hire rate per day.<\/span><\/li>\n
              • Tome Balloons and Decorations Inc is not responsible for any floor wrap\/decal damage.\u00a0<\/span><\/li>\n<\/ul>\n

                 <\/p>\n

                CANCELLATIONS\/DATE AND BOOKING CHANGES<\/b><\/p>\n

                 <\/p>\n

                  \n
                • Please be advised in the case of cancellation by the Client deposits are non-refundable, non-transferable, and cannot be exchanged for a credit note.<\/span><\/li>\n
                • Any cancellations made before the final payment is due the deposit will not be refunded.<\/span><\/li>\n
                • Any cancellations made after the final payment but before 14 days prior to the event date, will receive a refund minus the non-refundable deposit.<\/span><\/li>\n
                • Any cancellations made 14 days prior to the event date; will be charged the full rental rate plus any delivery\/installation fees.<\/span><\/li>\n
                • No refund will be issued if the event is canceled due to weather or any other circumstances out of our control.<\/span><\/li>\n<\/ul>\n

                  INDEMNIFICATION<\/b><\/p>\n

                   <\/p>\n

                  • Client agrees to indemnify, defend, and hold harmless Tome Balloons and Decorations Inc, Its employees, agents, and third parties, for any losses, costs, liabilities, and expenses (including reasonable attorney\u2019s fees) relating to or arising out of your use or inability to use equipment or services, any user postings made by you, or any violations of the third party.<\/span><\/li>\n
                  • Tome Balloons and Decorations Inc is not responsible for any personal injury or damage caused by the misuse of the equipment. Hold Harmless: the renter assumes all risk inherent in the operation and use of the rented equipment by themselves and anyone else. The renter assumes the entire responsibility for the defense of, and to pay, indemnity. And hold us Harmless from, and release us from any and all claims for damage to property or bodily injury (including death), or loss of time and inconvenience resulting from the use or possession of rental equipment, whether or not it be claimed or found that such damage or injury resulted in whole or part from our negligence, from the defective condition of the rented equipment or from any cause.<\/span><\/li>\n<\/ul>\n

                    • Pick Up Included on Invoices is ONLY up to 8pm.\u00a0<\/span>\n

                      • After 8pm additional fees will apply: $75 pick-up 8:01pm -10:30pm.<\/span><\/li>\n
                      • $150 pick-up 11pm – 12am<\/span><\/li>\n
                      • $250 pick-up 12:30am-2am<\/span><\/li>\n<\/ul>\n<\/li>\n
                      • Contact us for Miami late-night pick-up fees.<\/span><\/li>\n
                      • We reserve the right to Tag any vendors on any Social Media Platform, including but not limited to the vendors directly hired by Tome Balloons and Decorations Inc.\u00a0<\/span><\/li>\n
                      • We reserve the right to update this agreement at any time.\u00a0<\/span><\/li>\n
                      • Please read our terms & conditions . Payment for your booking will indicate that you read, understood, and agreed to the terms and conditions.<\/span><\/li>\n
                      • By making a deposit the customer agrees to the services and conditions described in this documen<\/span><\/li>\n<\/ul>\n
